5. Content and Social Media Management
Where we provide services that involve posting content to your website or social media platforms:
5.1. Responsibility: Online Web Store Ltd (trading as Every Enquiry) accepts no responsibility for the content posted. You (the client) hold sole responsibility for ensuring that all content is legal, decent, honest and truthful.
5.2. Posting and Review: We may publish content to your platforms before formal approval is received. It is your responsibility to review all published material immediately. You accept full retrospective responsibility for any content published on your behalf. If you require any changes or removal, you must notify us in writing immediately.
5.3. Indemnity: You agree to indemnify and hold Online Web Store Ltd harmless against any claims, damages or legal proceedings arising from content published on your behalf.
5.4. Rights and Permissions: You must ensure you have the necessary rights and permissions for any materials (including images, text and logos) provided to us for publication.
5.5. Access: You are responsible for providing and maintaining the necessary access and permissions for us to post on your chosen platforms.
5.6. AI-Generated Images: We may use Artificial Intelligence (AI) tools to generate images for use on your social media and/or website. You acknowledge that the legal landscape relating to AI-generated content, copyright and ownership is evolving. You accept full responsibility for the use of any AI-generated images used on your behalf, including ensuring they do not infringe any third-party rights. We provide no guarantees that AI-generated images will be copyrightable or that any ownership rights will vest in you (or us). You agree to indemnify and hold Online Web Store Ltd harmless against any claims, damages, liabilities, losses, costs or legal proceedings (including reasonable legal fees) arising from or connected with the use of AI-generated images created or used in connection with your services.
6. Lead Follow-up, Automations, and Outreach
6.1. Automations: We may use automated systems to follow up on leads generated for you. You are responsible for the accuracy of the information you provide to these systems.
6.2. Cold Outreach and Legitimate Interest: Where you request cold outreach to prospects, you warrant that any data or contact lists you provide to us are fully compliant with the UK GDPR and the Data Protection Act 2018. You confirm that such outreach is conducted under the lawful basis of “Legitimate Interest” for business-to-business (B2B) communications.
6.3. Lawful Basis: You are responsible for conducting and documenting a Legitimate Interest Assessment (LIA) where necessary to justify the outreach.
6.4. Opt-outs: All outreach communication sent by us on your behalf will include a clear and conspicuous option to unsubscribe or opt-out.
7. Data Protection (GDPR)
7.1. Roles: For the purposes of data protection legislation, you are the “Data Controller” and Online Web Store Ltd is the “Data Processor”.
7.2. Compliance: We will process personal data only on your documented instructions and in accordance with applicable data protection laws.
7.3. Indemnity: You shall indemnify us against any costs, claims, fines or penalties resulting from a breach of data protection laws caused by your failure to provide compliant data or instructions, including but not limited to the misuse of Legitimate Interest as a lawful basis.

8.1. Either party may terminate the service agreement by providing thirty (30) days’ written notice to the other party.

8.4. We reserve the right to suspend or terminate services immediately if you breach these Terms or your service agreement.
9. No Refunds Policy
7.1. All payments made for our services are non-refundable.
7.2. No refunds will be provided for any reason, including but not limited to early termination, unused services or dissatisfaction with services.
7.3. This policy applies to all payments made to Every Enquiry regardless of payment method or frequency.
10. Intellectual Property Rights
10.1. All content on our website, including but not limited to text, graphics, logos, images, software and design, is the property of Online Web Store Ltd or its licensors and is protected by intellectual property laws.
